These Terms of Service (“Terms”) govern your access to and use of this website (the “Site”) and, where applicable, your purchase or use of services provided by RockLeaf Landscaping (“RockLeaf,” “we,” “us,” or “our”). By using the Site, requesting an estimate, or engaging us for services, you agree to these Terms.

If you do not agree, please do not use the Site.

1) About RockLeaf Landscaping

RockLeaf Landscaping provides landscaping design/build and related outdoor construction services across the Greater Toronto Area (GTA) and surrounding communities, including Toronto, Mississauga, Oakville, Milton, Georgetown, Brampton, Caledon, and nearby areas.

Our services include (but are not limited to): landscaping, stonework, planting and sod installation, woodwork, and swimming pools.

2) Estimates, Consultations, and Quotes

  • We offer a free in-home estimate/consultation.

  • Any estimate or quote provided is based on information available at the time, including site conditions observable during the visit and the scope discussed.

  • Quotes may be subject to change if site conditions, access, materials, client requests, or other assumptions change.

A quote is not a binding contract. A binding agreement is formed only when both parties confirm scope, pricing, and timelines in writing (e.g., a signed proposal, work order, or service agreement).

3) Scope of Work and Change Requests

  • The work we perform is limited to the scope described in the written agreement.

  • Any additions, removals, substitutions, or changes requested by you may require a written change order and may affect price and schedule.

  • We are not responsible for delays or costs caused by changes requested after work begins.

4) Scheduling, Project Timelines, and Access

  • Start dates and timelines depend on project scope, seasonal demand, weather, permitting, and material availability.

  • You agree to provide safe and timely access to the work area, including gates, driveways, water, and electrical access where required.

  • If access is blocked or conditions are unsafe, we may pause work until the issue is resolved, which may impact schedule and costs.

5) Site Conditions, Underground Utilities, and Client Responsibilities

Outdoor construction depends heavily on site conditions. By proceeding, you acknowledge that:

  • Soil conditions, grading, drainage, buried debris, roots, or hidden obstacles can impact scope, cost, and timeline.

  • You are responsible for disclosing known underground items (e.g., irrigation lines, lighting wires, septic components, invisible dog fences).

  • Utility locates may be required for certain work. If locates or approvals are needed, responsibilities will be outlined in your written agreement.

6) Pricing, Taxes, Deposits, and Payments

  • Unless otherwise stated, all pricing is in Canadian dollars (CAD).

  • Applicable taxes (e.g., HST) may apply depending on the service and jurisdiction.

  • Deposits, progress payments, and final payment terms (including due dates and accepted payment methods) are specified in your written agreement.

  • Late payments may result in paused work, rescheduling, or additional fees as permitted by law and/or your agreement.

7) Materials and Substitutions

  • Materials, product lines, and finishes may vary due to availability, supplier changes, or site suitability.

  • If a specified material becomes unavailable, we may propose a comparable substitute. Any price impact will be communicated and, where required, approved in writing.

8) Weather, Seasonal Limits, and Force Majeure

Landscaping and outdoor construction can be affected by weather and seasonal conditions (including freeze/thaw cycles). Weather delays are not a breach of contract.

We are not liable for delays or failure to perform due to events beyond our reasonable control, including severe weather, supply chain disruptions, strikes, government actions, or emergencies.

9) Warranty

RockLeaf provides a 5-year limited labour warranty on eligible labour/workmanship as described by our warranty terms.

Important notes:

  • Warranty coverage details (what’s included/excluded, claim process, and conditions) may be provided in your estimate package, invoice, or written agreement.

  • Manufacturer warranties (for products/materials) are provided by the manufacturer, not RockLeaf.

  • Warranty may not cover issues caused by misuse, lack of maintenance, extreme weather events, settling/heaving beyond reasonable expectations, third-party modifications, or factors outside our control.

10) Maintenance and Aftercare

Many installations (especially plants/sod, natural materials, and outdoor structures) require proper maintenance. Unless your agreement includes ongoing maintenance, you are responsible for routine care (e.g., watering, seasonal protection, and recommended upkeep).

We may provide general care guidance; however, results can vary based on site conditions and ongoing maintenance.

11) Cancellations and Rescheduling

  • Cancellation or rescheduling policies (including notice requirements and any applicable fees) will be stated in your written agreement.

  • If materials have been ordered or work has started, cancellation may result in non-refundable costs (e.g., special-order items, disposal fees, restocking, or committed labour).

12) Use of the Website

You agree not to:

  • misuse the Site,

  • attempt to gain unauthorized access to systems,

  • interfere with Site functionality,

  • upload malicious code, or

  • scrape or reproduce Site content without permission.

We may suspend or restrict access to the Site if we believe misuse has occurred.

13) Intellectual Property

All content on this Site including text, photos, graphics, logos, and design elements is owned by or licensed to RockLeaf and protected by applicable intellectual property laws. You may not copy, reproduce, modify, publish, or distribute Site content without prior written consent.

14) Photos, Portfolio Use, and Testimonials

Unless you opt out in writing, you grant RockLeaf permission to photograph or video completed work at your property for portfolio, marketing, and social media purposes, provided we do not intentionally disclose personally identifying details (e.g., full address) without permission.

15) Third-Party Links and Platforms

The Site may link to third-party websites (e.g., social media). We are not responsible for third-party content, policies, or practices. Your use of third-party sites is at your own risk.

16) Disclaimers

  • The Site is provided “as is” and “as available.”

  • While we strive for accuracy, we do not guarantee that all Site content is complete, current, or error-free.

  • Landscaping and construction outcomes can vary due to weather, site conditions, and maintenance practices.

17) Limitation of Liability

To the maximum extent permitted by law:

  • RockLeaf will not be liable for indirect, incidental, special, consequential, or punitive damages.

  • Our total liability for any claim related to services or the Site will not exceed the amount you paid to RockLeaf for the specific services giving rise to the claim.

Nothing in these Terms limits liability where such limitation is not permitted under applicable law.

18) Indemnity

You agree to indemnify and hold harmless RockLeaf from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party rights.

19) Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles. You agree that any disputes will be brought in the courts located in Ontario, unless otherwise required by law.

20) Changes to These Terms

We may update these Terms from time to time. The “Effective date” above will reflect the latest version. Continued use of the Site after changes means you accept the updated Terms.
